Restitution Services

Per 1202.4 (a)(1) of the California Penal code: “It is the intent of the Legislature that a victim of crime who incurs any economic loss as a result of the commission of a crime shall receive restitution directly from any defendant convicted of that crime.”   Every court center is staffed with a well trained Restitution Specialist to assist crime victims in obtaining court ordered restitution from offenders.  If a defendant was ordered to make restitution the defendant will be ordered to appear in the Victim/Witness office either immediately or with 72 hours of being released from custody.  After the defendant has checked in the Restitution Specialist will review the DA file and any police reports to locate possible victims.  Once a Specialist has contacted you, submit all forms, estimates, and documentation needed to determine restitution.  In general, Restitution Specialists are directed to determine restitution on misdemeanor cases.  Victim Advocates are also well trained on restitution matters.  A Victim Advocate can assist crime victims in obtaining the needed documentation and presenting it to the Deputy District attorney handling their case.  Restitution Specialist and Advocates will help you complete the necessary forms to insure that you have every opportunity to collect your restitution; to help make you as financial whole as possible. Crime victims may also be eligible for there losses as a result of a crime through the California Victims of Crime Compensation Program.

  • Mental health/counseling expenses
  • Wages or profits lost due to injury
  • Attorneys fees for loss recovery
  • Replacement value of stolen or damaged items
  • Repairs to damaged items
  • Costs to install security devises
  • Interest at 10% per annum
  • Retrofitting of residence or vehicle if made handicap as a result of crime
  • Any loss demonstrated to be directly related to the crime
